What is this lawsuit about?
The Litigation seeks damages for EOG Resources, Inc.'s (the "Defendant") alleged failure to properly pay statutory interest on payments made outside the time periods set forth in the Production Revenue Standards Act, 52 O.S. § 570.1, et seq. (the “PRSA”) for oil and gas production proceeds from oil and gas wells in Oklahoma. Defendants expressly deny all allegations of wrongdoing or liability with respect to the claims and allegations in the Litigation. The Court has made no determination with respect to the merits of any of the parties’ claims or defenses. What does the Settlement provide?
Defendants have agreed to pay Four Million Dollars ($4,000,000.00) in cash (“Gross Settlement Fund”). The $4,000,000.00 cash payment is referred to as the “Gross Settlement Fund.” The Gross Settlement Fund, less Class Counsel’s Fees and Litigation Expenses and Administration, Notice, and Distribution Costs, and other costs approved by the Court (the “Net Settlement Fund”), will be distributed to Final Class Members pursuant to the terms of the Settlement Agreement.
Who is included?
The Settlement Class in the Litigation consists of All non-excluded persons or entities to whom Defendant (or Defendant’s designee): (1) made Late Payments between and including October 10, 2014 and January 12, 2021 for oil and gas proceeds from Oklahoma wells, and (2) the payments did not include the statutory interest under Oklahoma’s Production Revenue Standards Act (PRSA), 52 O.S. § 570.1 et seq.
